Round Rock, TX asked in Immigration Law for Texas

Q: How not to get out of status?

The immigration officer only gave me a one-month stay, which affects my travel schedule, my plan to meet my US colleagues face to face (since I am a remote worker, a software engineer), and losing money since I already paid for my stay and airline tickets to new York, I am in Austin at this moment, I filed a stay extension, but in the uscis official web page they advise to do this with at least 45 days of anticipation before the i94 expires, but in my case how I do not get out of status if she just gave me 30 days, which makes this impossible?

A: Consider scheduling a consultation with a competent and experienced immigration attorney. You might want to try to contact a supervisor at a U.S. Customs & Border Protection deferred inspection site to see whether they might view the limited duration of status given by the officer as an error and amend the duration of status on your I-94 card to a later date. See, e.g., https://www.cbp.gov/contact/ports/deferred-inspection-sites ("The Deferred Inspection Site staff is . . .available to review and issue the necessary documents to remedy errors recorded on arrival documents issued at the time of entry to the United States relating to . . . incorrect period of admission, if appropriate. ") An attorney might be able to help you with this possible remedy. Note also that ever since the onset of the COVID-19 pandemic, many attorneys offer telephonic and online video consultations.
