A: Contact your bankruptcy lawyer snd the court to make them aware of the 40k in fees.

A: Your bankruptcy lawyer should be able to review the papers and answer your questions. The bankruptcy court cannot do anything without a motion or pleading filed to bring it to the court's attention. You don't mention what the fees are for but if there was a judgment in the foreclosure case that would explain a lot (daily interest, legal fees, etc.). Talk to your lawyer and if you are not getting a response seek a second opinion.
