Cleveland, TX asked in Criminal Law for Maryland

Q: I need the best lawyer for an expungement for a 1993 B&E and numerous charges that followed it making it a felony

I was a senior in high school and unfortunately was 18 and charged with some charges that I need to have expunged. It’s been over 20 years but it’s still haunts me I have my masters now and would like to have it taken away from my background.

A: Expungement is something the statute allows or disallows depending on the specific sections of the code your offense is charged under, so the skill of the lawyer plays little part, although a good lawyer can research your particular charges to confirm whether they are eligible for expungement. Maryland has permitted expungement of a number of convictions charged under the criminal code after the passage of time, so your particular charges may be eligible. Contact a lawyer to review the your past criminal history and to prepare and file for expungement on those that are eligible.

A: You may be eligible for expungement depending on the exact charge and whether you had any subsequent charges. If you received probation before judgment, you can get your record expunged so long as three years expired from the entry of the PBJ and you did not have any convictions during that period.

If you were convicted of fourth degree burglary, you are eligible for expungement 10 years from the end of your probation or conviction whichever is later and you cannot have any subsequent convictions.

If you were convicted of 1st, 2nd, or 3rd degree burglary, you are eligible for expungement 15 years from the end of your probation or conviction whichever is later and you cannot have any subsequent convictions.

You should speak with a lawyer.
