Q: My baby mama is taking my son to Africa, we have an active child support case,can she travel with my son& what can I do
She’s leaving for 3 weeks, she lied to court that I was there for her since birth when I have always been there, did baby shower, paid for her rent when she gave birth etc and when it was time for her to get back to work, I changed my schedule so she can go to work, I used to stay with my son everyday till she finishes work then I go drop my son, then one day she decided to put my son into daycare without me knowing because I told her that I wouldn’t contribute to her rent. I said my only responsibility is to my son, if she can’t pay her rent I can live with my son. And why would my son go to daycare when I have been taking care of him since he was 3 months. So now she took me to court and lied that I have never been there for my son. So now I only see my son once a week. And she’s taking him to Africa for 3 weeks without letting me know because she said I have no say. We are waiting for the dna results to come but is she allowed to leave the country with my som?
A: If paternity has not yet been established and you have not been adjudicated the father, she can come and go with him as she pleases because your rights have not yet been legally established.
