Q: Can an ex refuse to return a 17 yr old when it's still 42 days until her 18th birthday?

My step-child doesn't want to come back from visitation because she doesn't want any of the responsibilities in our household and her other parent is enabling and refusing to bring her back and there is no time (42 days) to modify before the child turns 18 but the current custody order states the child is supposed to live and go to school here. She won't turn 18 until 41 days after school starts. Can my ex just not bring our child back? Will there be legal repercussions on the Primary custodian if the Non-custodial parent refuses to cooperate? They live in another state.

A: Make a motion to hold them in contempt for failing to comply with the order. There will only be legal repercussions for them if you pursue sanctions for this behavior.
