Q: Do I have to let my child's father have alone visits if I get child support? He is narcissistic and has mental issues ?

A: Pursuant to Ohio Revised Code 3109.042 an unmarried female who gives birth to a child is the sole residential parent and legal custodian of the child until a court of competent jurisdiction issues an order designating another person as the residential parent and legal custodian. This means that the Mother is allowed to deny visits altogether if she so chooses. An unmarried Father in Ohio must file papers in the County Court of Common Pleas Juvenile Division to request that the court establish paternity and/or to allocate the parental rights and responsibilities concerning the minor child. A mother may file for child support at her local child support enforcement office. Many times when a mother files for child support it will prompt a father to allocate his parental rights and responsibilities for shared parenting or parenting time.
