Asked in Criminal Law, DUI / DWI and Traffic Tickets for Utah

Q: I was stereo typed, passing this cop, he flipped around as i pulled into my trailer park which is posted no trespassing

Our lots are owned by the people not rented. He sped up im already around the corner and pulled up to my house. Flips his lights. He asks for my info and pulled me out of my truck. Doesnt say or ask anything takes his dog and goes right in my truck. Can he do that? Im asking him hey where is your prob. Cause? Hey i didnt give u permission to search. Im ignored. Im not on paper he cant do any of this. Oh yeah reason for pulling me over “ “licence plate cover tinted”……when all is said and done found a pipe and a syringe gave me a dui metabolite…….this was all bogus right? Please tell me this isnt going to fly. Also hours later wanted me to give him blood… i said hell no you already stomped all over my rights. So then he ccalled some judge and got a warrent to take it by force if nessary. The cop stabbed me like 3 times couldnt get it so then he called fire department then 5 firefighters showed up. One finally got my blood. Can they do that none of this is right right?

A: You need to contact an attorney to review and assist you in your case. You need an attorney. Do not speak to anyone about the case and consult with an attorney. Based of what you're saying there are likely many issues with the officers conduct, but until an attorney looks at all the police reports, videos, etc... it is difficult to know for sure. Call an attorney asap. Also, if you got the DUI recently, you only have 10 days to request a hearing with the driver license division to try and stop them from suspending your license. It sounds like you refused the blood test and so you license will be suspended for 18 months or three years if this isn't the first DUI.
