Q: Can I go to jail if I take claim of drugs that someone else is being charged with even after the cops let me go?
Me and my boyfriend ran out of gas so we made sure the truck was far enough away from the road next to an orchard which we figured was private property. There were no "no trespassing" signs or anything like that. When our friend finally showed up to bring us gas a cop who was driving by stopped to "check and make sure we were ok" in his words. We told him we were fine and we're getting ready to leave and he asked if anyone was on probation and my boyfriend was and they searched his truck and found over an ounce of meth. They never asked me anything about it. They immediately arrested my boyfriend and let me take his truck home. I don't have a license. The cop never asked if I did have one. If I go to his court date and tell them the meth was mine will they have to drop all charges against him from that night that concern the meth? Can they arrest me for it or no because they let me go that night without even asking me if it was mine?
A:
you should retain or request a criminal defense lawyer at your arraignment.
your lawyer needs to review the police report to determine all the facts.
before you talk to the cops/DA/Judge, consult with a private lawyer, who will no doubt tell you to SHUT UP.
you could be exposing yourself to arrest and perjuring yourself and wind up in custody.
