Q: in S Carolina. A large construction equipment rental co rents out 34ft lift. Improper maintenance caused bodily injury.

In South Carolina. A rental company of construction equipment with 3 locations rents out a unit that causes bodily injury. Due to injury is tooth loss and damage to teeth. Prosthodontist all have payment due at time of service. To obtain proper treatment how can you obtain the rental companies liability insurance limits. The insurance limits are needed to obtain a surgical loan so that treatment can be done. All other avenues have been exhausted and now the situation is life threatening with infection throughout facial bones. Cost to remove infection and roots from teeth still in gums is 25,000 to remove infection ect. Total cost to bring patient back to origional state just prior to accident is additional 50,000. Dental industry requires payment at time of service. Only due to now delays in treatment condition is life threatening needing immediate surgery. Policy limits are needed to obtain a surgical loan on lawsuit award. Since it was not vehicle how do we obtain limits for loan

A: They are not required to provide you the insurance limits before a lawsuit is filed. After a lawsuit is filed on your behalf you could get them through the written discovery process.
