Q: I rent a1bdr condo in South FL.My lease ends Aug 31st.My landlady just told me she's putting it on the market in 3 days.
I'm in my 60's with compromised health and due to Covid concerns,am fearful of having a bunch of realtors and strangers coming through my home as I'm afraid of catching Covid. I don't want to show the place as masks are not enforced here.In addition I rented this place furnished 5 yrs ago and due to my health concerns and personal needs have had to buy more comfortable furniture for my back.I don't want them to bring a photographer in here as it looks a bit crowded and crazy in here and I don't want my private belongings photographed.My landlady lives overseas so I'm working with her realtor.My questions are can they just use the condo photos they used with me when I rented it?And can I be made to show my home in the middle of the Pandemic when I have underlying health concerns?Can't they just list it as tenant occupied with old or no photos?Lastly,I was laid off due to the Pandemic and am retired,living on a fixed income.Now I must get a work from home job in case I have to move out.
A: Generally, you have to cooperate with your owner because its her property. Your lease may give specifics. The key is reasonableness. Even if its sold, the new owner takes subject to your lease; your lease doesn't end with the sale. However, if the new owner chooses to not offer you a new lease, you have no recourse and will have to move. You should begin to plan for that circumstance now.
