Q: what to do when judge gave 21 days to enroll in outpatient program but you are still not enrolled after 26 days?
I misinterpreted what the judge had ordered. I am on paroll with only a couple months until I am off. I took a plea deal for a possession case that was a misdemeanor. the deal was for no jail time but i had to enroll in a drug and alcohol program under prop 36. I was to be on probation for a year and with completion the misdemeanor would be dropped. I was given 21 days to enroll but I ended up getting covid and I was delirious for a couple weeks. i thought for some reason the judge gave me 31 days. After re reading a paper i noticed that I am now not enrolled with the time allotted. what can I do? i really never want to set foot in a jail again. I am so upset with myself for screwing this up. please help with any advice. i am afraid to step in court and be arrested. I have an apartment and a dog and I am nervous.
A:
EXPLAIN ALL THIS TO YOUR LAWYER. IF YOU HAVE DOCUMENTATION OF THE COVID GIVE IT TO YOUR LAWYER.
S/HE WILL MAKE A MOTION TO SET ASIDE IF THERE IS A BENCH WARRANT AND ASK THE JUDGE FOR MORE TIME...............WE GET THAT DONE ALMOST 100% OF THE TIME.
