Spring, TX asked in Family Law for Texas

Q: My prenup states i only get 50% of the appreciation of the home. We are in Montgomery county. How is that determined?

The house is at 58 Oak Estates Drive Conroe, TX 77384. It is in my husbands name. We married soon after the purchase of the home. I signed a prenup that I get 1/2 of the appreciation of the home. I do not understand how that number is determined and I would like to have a better idea because I am 46 and have medical issues. I can't afford a lawyer. I found an apartment and as soon as my daughter and i moved in, he changed the locks to our home and put anything i had in the garage, only allowing access to that area. He is telling me I have to sign the agreement he is coming up with which is worth about 55K or he won't provide me any money for living expenses. I don't work, I have a teenager living with me and my husband is financially bullying and cornering me. I am trying to make it and get treatment under control regarding my health and at this time, he is leaving me and locking us out. Nothing seems fair and i am not able to take much more of his control/financial abuse.

A: Appreciation is the increase in the value of the home over time. Determine the value of the home today and subtract the value of the home at the time of the prenup (or at the time specified in the prenup if it specifies a different time). That is the amount of appreciation. Then divide by two to calculate half.

A: Get the house appraised and than go to the date of prenup and see what mcad valued the house
