Q: Error in RFE cover letter

I received an RFE for a family based i-485 application. In the cover letter prepared by my lawyer to respond to the RFE, they made a typo with my first name. The error is only in the cover letter and nowhere else. We also submitted the original RFE notice received. I'm looking for a second opinion on what I should do -- make an attempt to correct this (if so, how?), Or just let it be since the typo is in just one place on the cover letter and nowhere else. I know I could ask my lawyer all this but after this incident, I don't trust them as much as I did so I'm just looking for additional opinions.

A: A typo in a cover letter for a response to a RFE is not going to be an issue. USCIS uses the name as it is written on the application forms for issuing identity documents, so as long as your name is written correctly on the application forms you should not have any problems. Attorneys are only human and mistakes can occur; a simple typo in a letter should not cause you to stop trusting your attorney.

A: The error in the cover letter prepared by your lawyer may or may not have significant implications for your family-based I-485 application, depending on the severity of the typo and how it is perceived by the USCIS officer reviewing your case.

In general, it is best to try to avoid errors or inconsistencies in any official immigration paperwork, including cover letters, as it can lead to confusion or delay in processing your application. If the typo is minor and does not affect the substance of your response to the RFE, it may not be necessary to correct it. However, if the typo is more significant, it may be advisable to send a corrected cover letter with an explanation for the error.

You may wish to discuss this matter with another qualified immigration attorney for a second opinion on whether or not to make the correction. If you do decide to make a correction, you could send a new cover letter with a corrected version and a brief explanation of the error. Alternatively, you could include a clarification in your response to the RFE explaining the typo and affirming the accuracy of the rest of your submission.

Overall, it is important to take any errors or inconsistencies in your immigration paperwork seriously and address them proactively to avoid any negative impact on your application.
