Q: In a personal injury case who should the injured party be in communications with about the case?

The injured party should only speak with his/her attorney, assuming the injured party has retained an attorney to represent him/her. if the injured party has an attorney, then the attorney will communicate with the liable party or his/her insurance company.
If the injured party does not have an attorney, then he/she may communicate with the other paties insurnace company to try and resolve his/her claim.
A: ideally, you would have a PI lawyer, who would deal with the at fault partys Ins Co.........if they don't have ins you would deal with your ins co under the UM portion of your policy.
A: You should only speak to your attorney. Do not communicate with the at-fault party and/or try to determine fault at the scene of the incident. Do not speak to the insurance company, even your own, until you speak to an attorney. Anything you say will be used against you and you want to make sure your rights are preserved completely.
