Cleveland, OH asked in Criminal Law for Ohio

Q: Is it possible to request a retrial for a case I was sentenced on during covid?

I was sentenced to a disorderly conduct in 2018 which I was issued a citation, appeared before the court, entered a guilty plea for reduced sentencing which included not being incarerated for the imposed sentence. The incident was a direct result of eradict behavior not diagnosed until several years later. Is it possible to request for a court to reexamine this case with not only relevant information not available at the time as well as the fact that I was instructed to accept a plea bargain so that I was not incarcerated during the initial waves of Covid occuring in jails and prisons during that time?

A: You may want to explore if there are any grounds to file a a motion to vacate the guilty plea with the court on the basis that you did not knowingly, intelligently and voluntarily waive your right to a jury trial by entering the guilty plea.
