A: Psychiatric cases are handled like any other malpractice lawsuit. The plaintiff must demonstrate a departure from the accepted standard of psychiatric care; and that the departure from care was a substantial factor in causing an injury. An error in judgment is a valid defense to any malpractice action if the prescribed course of treatment was based upon an appropriate evaluation and was one of several accepted courses of treatment. That it turned out to the be the wrong one is NOT malpractice.

A: The standard is one based on breach of a duty of care - existence of a duty, breach of the duty, damages that ensue, and that the breach is proximate cause of the damages. Good luck
