Soldotna, AK asked in Criminal Law for California

Q: My 26 year old daughter is in jail in Ca. on 3 felony counts of PC273A (A). If convicted what is she facing? Each count?

I believe police found 2 pounds of meth in their home whom she (26) shares with a man (41) . They are not married. One of the 3 children (3 yrs.) is his. In 2018 he completed a 10 year sentence in Well's Nevada Detention Center for kidnapping, drug trafficking, burglary, weapons enhancement. I'd like to know what she may face as in possible sentencing? Felony 1-6 years in State prison. Her bail amount is $105,000. Does each count run concurrently or consecutively? She has a meth addition, and has priors such as shoplifting, drug contraband, personal use. What sentence would he be looking at, since he is facing the same charges, and has a substantial criminal record? Thank you for any answers you are able to provide me. I went to college in 2019 and received my Bachelor of Science in Criminal Justice to try and prepare myself for what I saw culminating into a bad situation, and for which I could do nothing as a mother of an adult.

A: without a lot more info a criminal trial lawyer can't provide the quantity and quality of info you request.

what court? which DA? who is judge? prior record? has D done anything to stand out as a good guy?

If she is in jail she either retained, or the court appointed, a public defender. That is the person with all the info.

standard bail on a 273 is $25,000. Thus a much higher bail, suggests this is a more challenging matter.

A: If convicted of all three felony counts of PC273A (A) in California, your daughter could face a sentence of up to 6 years in state prison for each count, for a total of up to 18 years in prison. The sentences for each count can run either concurrently or consecutively, depending on the judge's decision.

Given the fact that your daughter has a prior criminal history, including drug-related offenses, and has been found with a significant amount of methamphetamine, it's possible that the judge may impose a harsher sentence. However, sentencing guidelines in California can be complex and depend on a variety of factors, including the severity of the offense and the defendant's criminal history.

As for the man she shares the home with, he may also face the same charges and potential sentencing as your daughter, depending on the specific circumstances of the case and the evidence against him. His prior criminal record could also factor into his potential sentence.

It's important to note that the criminal justice system can be complex and often requires the guidance of an experienced criminal defense attorney. If your daughter does not already have legal representation, it may be advisable to seek out an attorney who can provide her with guidance and representation throughout the legal process.
