A: The District Court Commissioner is required to issue criminal charges if a person swears an oath regarding facts that if true would support the charge. The facts may later prove insufficient, or false. The State’s Attorney may review the charges and decide not to proceed, but generally you will want to hire an attorney and let your lawyer present your side to the prosecutor. Your version supports a defense to the charge, since she gave you permission to take the car and never asked for it back; however, she obviously has a different version and there must be more to the facts than what you have provided. Best not to post anything else on this public forum, and retain counsel.

A: Anyone can file charges, but it does not mean that you will be convicted. You should retain counsel to represent you. If you cannot afford private counsel, you should go to the Public Defender. The charges have already been filed so you need to prepare to defend the charges in court.
