A: The named beneficiary of the annuity death benefit needs to make a claim with the insurance co. directly. Usually annuities are not estate assets but an estate fiduciary will administer them as additional duties since they have letters. If no results quickly,then sue the ins. co. for the money for breach of contract by a third party beneficiary. If executor already has money, then you must sue him for conversion and breach of fiduciary duty.
