Brooklyn, NY asked in Medical Malpractice and Personal Injury for New York

Q: Attorneys familiar with the medical field

How can I go to my local hospital with no insurance (except emergency Medicaid) and get the treatment I need. How can I convince the doctors that I have a c.s.f. leak (cerebrospinal fluid)and for them to give me an E.B.P. (epidural blood patch)It is a life threatening emergency because after that comes meningitis then coma then death. I have H.O.D. (hypertrophic olivary degeneration)from a previous surgery and that has similar symptoms as a leak, which they concentrate on and conclude any further testing but that doesn't mean the leak is not there and who's to say my symptoms are coming from the H.O.D. and not the leak? Plenty of people have H.O.D and never have a symptom.

Thank you

A: Sorry to hear what you're going through. Generally speaking, you cannot present to an emergency room (or for that matter any medical facility) and force them to treat your own self-diagnosis. Based upon your clinical presentation and medical history, a physician will reach his or her own differential diagnosis and prescribe an appropriate course of treatment, which may or may not include diagnostic tests. If you are concerned that you have a CSF, tell the doctors and ask them to explain to you why they think otherwise.

A: I'm sorry for your ordeal. One possibility is to seek a supporting diagnosis from another physician(s). However, there are no guarantees there. A medical facility could still maintain its own conclusions and diagnosis. Good luck
