Columbus, OH asked in Family Law for Ohio

Q: I need to find out if my marriage is valid.

In 2008 when applying for a marriage license in Boone County Kentucky to my 2nd husband, I specifically asked the clerk at the courthouse if I could use my maiden name since I didn't want my ex husband's name on my new marriage license. I was told yes. I assumed the clerk would have known if this was permissable. Fast forward to this year, my husband and I move to Butler County Ohio and I go to the DMV to get an Ohio license and basically the DMV manager tells me that since my name and SS# is listed under my ex husband's name in their system that my marriage could be invalid. I called the Boone County Circuit clerk's office, explained the entire story and I was advised to contact an attorney.
