Petaluma, CA asked in Real Estate Law and Landlord - Tenant for California

Q: I've lived apt for 7 years now. The person who moved below me 4 yrs ago complains constantly re minor noise.

I feel like she is harassing me. Banging on my door, yelling at me, banging on door. I'm a senior that lives alone and have never had more than one person at a time in my place, don't play music. Our apts are old and poorly build and she is very noise sensitive. Even walking barefoot on a carpeted floor sets her off. I can't contact my landlord because he is not mentally sound wants no problems. Last Jan 2022 I told her to leave me alone...not contact me again after repeated texts. We didn't talk again until December 2022 when we ran into each and unprovoked she began yelling at me (red in face-shaking) that I was a horrible person. When I asked calmly asked her to clarify she slammed door in my face. Since then we don't talk, until she sent a text message to me complaining that my 2 yo granddaughter was running and to be considerate. My GD has only been here 3x in past 2 yr. Is it best I text her back and tell her to contact landlord/police instead of me with complaints or ignore her?

A: That sounds like a difficult situation. Speak with a local attorney regarding your options. [I litigate cases. A: Given the ongoing conflicts and harassment you are experiencing from your neighbor, it may be best to prioritize your peace of mind and well-being. Ignoring her complaints and not engaging in further communication with her might help avoid unnecessary confrontation and potential escalation. Instead, consider documenting incidents of harassment and noise complaints in case they need to be addressed later. If the situation continues or worsens, it may be necessary to involve your landlord or seek advice from a legal professional to explore potential remedies or strategies to address the ongoing harassment.
