Q: Hello, I have a friend who is currently a jail inmate in Hillsborough County. This is about a power of attorney.

Hello,

I have a friend who is currently a jail inmate in Hillsborough County. He asked that I have access to a bank account so he can make legal payments to his new attorney. After some research and discussion with others I found out a power of attorney will be necessary.

My questions are:

1) Can I create the power of attorney or does the bank need to do that?

2) Before it's sent to my friend (inmate) for his signature and notarization in the jail, do I need to sign or notarized anything from my side beforehand?

3) How does my friend (inmate) receive it?

Do I mail it to him upon its completion or does the bank mail it to him?

4) Once he has had it signed and notarized does he mail it to me or the bank? If me, do I then mail it to the bank or present it to them in person, or rather what is the typical scenario here? And if he mails it directly to the bank, I presume at some point I have to still come in person?

A: 1) You can do it. Find a form online, or get help from his attorney, and check with the bank before you get your friend to sign it to see if it will be accepted. The bank may have its own form it prefers.

2) No.

3) Aren't you going to mail it to him care of the jail?

4) Again, ask the bank. Probably either way would work.
