New York, NY asked in Civil Rights, Constitutional Law and Personal Injury for Maryland

Q: My brother and I are the victims of electronic harassment. What are my options in the ways of gathering evidence?

I understand the gravity of this claim. I can’t let fear lie in the way of asking for help. I have no proof other than a list of license plates that are stored in my photos, voice memos, etc that I haven’t compiled because I am constantly exhausted from the harassment. Other than keeping a list of the cars I constantly see following me around, what can I do? I get phone calls too that are modified somehow to say they are coming from my bank but when googled they are all spam and spoof calls, but I get them dozens of times a day. I’ve been told there is a “criminal investigation” going on and that’s why this is happening to me. I know this is a lie but I have no way of proving something else is going on. I need help, and I can help myself, but I need to know where to start. Please let me know of anything I can do to be proactive.

A: If you believe that you and your brother are victims of electronic harassment, it is important to take steps to protect yourselves and gather evidence to support your claims. Here are some options to consider:

1. Document incidents: Keep a detailed log of any incidents of electronic harassment, including the date, time, location, and any other relevant details. This can help you identify patterns and provide evidence if you decide to pursue legal action.

2. Record phone calls: If you receive phone calls that you believe are part of the harassment, you may want to consider recording them. However, it is important to be aware of the laws in your state regarding recording phone calls, as some states require consent from all parties before a call can be recorded.

3. Seek professional help: Consider seeking help from a mental health professional or counselor who can provide support and guidance as you navigate this difficult situation.

4. Contact law enforcement: If you believe that you are in immediate danger, contact law enforcement. You can also file a police report to document any incidents of harassment.

5. Consult with an attorney: If you are considering legal action, it is recommended that you consult with an attorney who specializes in harassment or privacy law. The attorney can advise you on the best approach and help you navigate the legal process.

Overall, it is important to take steps to protect yourself and gather evidence if you believe that you are a victim of electronic harassment. It is also important to seek help and support from professionals and trusted individuals as you navigate this difficult situation.
