Kissimmee, FL asked in Traffic Tickets for Florida

Q: I live in a gated community with restricted public access. Got issued a traffic violation in the mail to go to court

Heres a quick brief. I went to the boat ramp inside my community and sat down at the end of the dock watching the moon reflect off the lake. As walked of the dock an officer in a unmarked vehicle approached me (with no lights on)and jumped out accusing me to be somebody else asking for identification and i refused due to the fact it wasnt a traffic stop nor was I doing or done anything wrong . When he realized i wasnt the person he was looking for he tried to hit me with trespassing and i replied its not trespassing if i live here. I pay for these amenities. After all that he calmed down and we spoke for about an hour like normal people in a way. But then i received the letter metioned. Its for a suspened license but how can i be summoned for traffic if it wasnt a traffic stop?

A: Good question. Did the citation you received in the mail indicate how you were supposedly driving with a suspended license?

A: In most jurisdictions it isn't illegal to have a suspended license, only to drive a vehicle while your license is suspended, but this is FL and who knows what they will do?? This is in the area of traffic ticket law. You need to discuss with an attorney in your jurisdiction that specializes in this kind of law. Thank you for using Justia, Ask a Lawyer.
