Q: It's been 5yrs since I been to court and didn't sign any papers and children are married with family wages being garnis

Went to court 3 times and she didn't show any of those times and didn't get for contempt of court wages are being garnished without my consent and didn't get any notice that they were going to garnish wages cause I didn't sign any papers the last time in court 5yrs ago and title IV-D is a corporation and is federal and state funded and a billion dollar company and want my money back that they took from me because it's not for the children and charge interest on back pay it's not a loan and the state put me in debt didn't use due process and against the 4th amendment and it's a civil matter federal law

A: If you owe child support pursuant to a court order, absent either an agreement or a court order to the contrary, wage garnishment of your support obligation is ordinarily required. It is not any sort of Due Process violation.

If a state agency provided any sort of benefits for your child (eg Medicaid, WIC, SNAP), it has an interest in collecting child support owed for your child. That does not violate the 4th Amendment.

Child support not paid in a timely manner accrues interest at the rate of 18% per annum. Therefore it is very important you timely pay your child support each month as required by the support order in place for your child.
