Q: I am a UK citizen and want to apply for the EB5 or EB1C visa. Is it possible to get a waiver through those programs?

In the UK prostitution is legal under certain circumstances. However to avoid getting into legal trouble the providers say that any money paid is only for their time. Would the US consider this as prostitution? From my understanding it carries a 10 year bar in the US from my understanding. I have no criminal convictions or ever been arrested. Would I be able to get a waiver for that or should I apply for an E2 visa and apply for the waiver and then adjust at a later stage?
