Rocky River, OH asked in Personal Injury for Ohio

Q: A third party administrator asked me for a “demand amount”. How do I determine this?

My son was given his allergen at Olive Garden and he had a reaction. Our copay was around $500

EDITED TO ADD: There were no lost wages and my son (16 years old) was already off from school the following day. I don’t know how to put a dollar amount on his experience. He was in pain, vomiting, skin turned red, hooked up to an IV, and had to take some medicines/inhalers for a while. But he’s ok now. I don’t know where to find information on comparable experiences.

A: You have to decide what amount you want to settle the claim, understanding that it will likely result in an offer lower than what you demand. Take into account medical bills, list wages. And pain and suffering at the very least when making a demand.
