Hampton Bays, NY asked in Landlord - Tenant for New York

Q: Sue my landlord raising rent twice in 7 months; broken kitchen sink 4 months; arrested (illegal eviction); shoved me etc

After he was arrested for blocking laundry room and threatening to lock me in the garage, less than two hours later a drunk guy he sent to threaten me and my husband came running down the hall screaming 'get the 'f' out - 911 recorded it all even with him saying his name and that he was an ex-cop/detective so he was taken out in handcuffs also (all in less than 24 hours for a measly $400). I have an order of protection (refrain due to the landlord letting him in) and he didn't show in court so it's on again in July (the harassment charge). Went to court with the landlord and have until June 30th at 5 p.m. to move out and we owe zero dollars. He still threatens more thugs to come after us so I don't sleep at night and says to watch our backs. Since the Stipulation of Settlement was signed, he took all the burners off the stovetop and sprayed inside the oven so haven't been able to cook either - pulled plugs on laundry machines; a year of hell with his evil games.

A: Your landlord is a criminal. Police and Disrict Attorney deal with crimes. If you wish for a Civil lawsuit, I suggest hiring an attorney. An attorney can focus on the facts and plead recognizable causes of action. For instance, NY State has no cause of action based on civil harassment. Perhaps a jury would award monetary damages, and you could take that house away from your landlord.
