Q: My name on the original deed to our home was removed by my Ex husband
My ExHusband passed away two months ago.I did not sign or give consent to be removed from the deed. His brother executor of Will ,will sell the home to his relative.what recourse do I have
A: Your name cannot be removed from a deed without your signature. If your ex-husband forged your signature on a deed removing you from title, you can challenge that now to prevent the sale, or in the alternative, receive half of the proceeds of the sale. Schedule a free consultation to have the deed reviewed and to create a plan of action.
A: Initially you need to search the Title and the Probate File at Court. Hire a FL attorney to do this quickly, then ask what can be done, especially litigation. Restraining Order Bonds will be expensive. Possibly a Notice Lis Pendens will slow down the sale, but suit has to be filed first. Hopefully the divorce decree did not divest and revest title.
