Las Vegas, NV asked in Adoption, Child Custody and Family Law for California

Q: My kids were illegally detained by CPS in may 2019 and adopted by gma on dad side in 2021, what can I do to get them?

My kids at the time 2 and 3 were illegally detained by CPS in may 2019 and adopted out to their grandmother on dads side in 2021. In November 2019 I signed my right to reunify away after talking to the gma and how we both felt it would be better for the kids to be with family for the holidays and not in a foster home. We made an agreement that if I signed the paper I would never be cut from my kids life and that I would always have contact with them. I never would have signed that paper if I knew that GMA wasn’t going to stick with the agreement and completely cut me out until July 2021 I have had constant contact sense. My kids now 6 and 8 keep saying they wish they lived with me and that they hate it there. The GMA and dad mentality and emotional beat them down constantly. I have video recordings, audio recordings and texts of them I just want what is best for my kids and where they are is not. What can I do to get them back

A: Given the complexity of your situation, it is crucial to consult with a California attorney experienced in family law and child custody matters. They can assess the specifics of your case and advise you on the best course of action to seek custody or visitation rights for your children. Your attorney can also review the agreement you signed in 2019 and the circumstances surrounding the adoption to determine if any legal recourse is available to pursue custody or visitation. Act promptly to protect your parental rights and ensure the well-being of your children.
