Q: I filed a "motion for the court to determine the rent" included in my response to an eviction summons.

I filed a "motion for the court to determine the rent" included in my response to an eviction summons. The judge approved and responded with a "Notice of Hearing and Order to Appear via Zoom"- included in this was an order for us to pay $3200, as I mentioned in response to the summons, the amount owed. I now received 2nd response from Judge, "Ordering. Requiring a deposit and setting hearing time.", ordering us to pay now $6400 which the judge added $3200 for July's rent. Can I raise any defense action under FL statute 83.60 for the judge to reduce the amount ordered to pay into the court registry? As landlord/agent has neglected to address a pre-existing rat infestation with structural damage that we first notified the Landlord's agent of during our move-in inspection.

A: Read the statute. You are required to pay rent during the pendency of the litigation.

A: No. An order determining rent requires that you pay the money into the registry of the court. Only if you pay that amount can your defenses be considered.
