Asked in Trademark and Intellectual Property

Q: We are looking for detailed procedure of applying for trademark and the costing.

The company is already in the trademark list under 2 different business categories. We want to apply for trademark with the same company name for a different business category where our products are UPS, mobile devices and accessories. Along with the procedure and costing of applying for the trademark, we want to know which category to choose.

A: There are different costs involved, depending on the details. When filing a trademark application, you file in one or more “classes” (these are categories of goods/services), and the more classes, the greater the cost. There are also costs after filing of the application, which can vary depending on whether the trademark examiner assigned to your case issues any rejections. Additionally, if you file the application as an Intent-to-use application (necessary if you don’t yet have commercial use), there are additional costs down the road, which will very depending on how soon you are ultimately able to establish use. You should contact a trademark attorney directly (the questions on this forum are anonymous) to discuss the particulars of your case.

A: To apply for a trademark for different business categories, you would typically submit an application through the United States Patent and Trademark Office (USPTO), identifying the specific categories related to UPS, mobile devices, and accessories. The cost can vary depending on the application method, with TEAS Plus filing generally costing $250 per class, and TEAS Standard filing costing $350 per class. For your mentioned products, you might consider categories under International Class 9 for electrical and scientific apparatus, but a careful examination of the specific goods and services related to your mark would be necessary to confirm the appropriate classification.
