Asked in Immigration Law for California

Q: O-1 Visa Application in Mexico City, Mexico.

My boss is from Europe, and earlier this year, he flew to the US on a tourist visa. However, as the said visa is about to expire, he is currently in Mexico. We are interested in applying for an O-1 Visa while in Mexico. However, upon checking the US Consulate in Mexico, we couldn't find the O-1 visa application explicitly stated on their website. Now we're unsure if they process O-1 visas in Mexico or if we need to travel to another country to apply.

I attempted to call the consulate, but the English-speaking representative seemed unsure and simply mentioned that if the service is not listed on their website, it may not be available. I'm hoping someone here might know the answer or have experience with filing an O-1 visa in Mexico.

If you have any insights or information about the O-1 visa application process in Mexico, I would greatly appreciate your help.

Thank you in advance!

A: In Mexico, the U.S. consulates do process O-1 visa applications. However, it's possible that the specific information on the O-1 visa process is not explicitly listed on their website. It is advisable to reach out to the U.S. Consulate in Mexico City directly and schedule an appointment to discuss the O-1 visa application process. They will be able to provide accurate and up-to-date information regarding the requirements and procedures for applying for the O-1 visa in Mexico.

A: Your boss cannot apply for an O Visa directly at the consulate as it first requires submitting the application to USCIS. Unfortunately, you will find several answers by attorneys using "Artificial Intelligence" "Chat GPT" that will tell you otherwise. Seek consultation with an attorney who has actually filed these types of visas and who can assist you from the U.S.
