Q: I need to file a claim against Brooke Army medical center pro se. Is it hard, do I need to attach medical records?
Is asking for 5 million too much. My sf95 was denied and so was my appeal.
A:
You will need to include with your filing the required report of a medical professional in the same field of medicine and the same area of specialization as the healthcare provider who you are accusing of malpractice. Be sure you understand exactly what is required.
What is reasonable in terms of damages depends heavily on how much money you have spent as a result of the malpractice. If you spent $2-3 million out of pocket as a result of the malpractice, $5 million is not an unreasonable demand if you also suffered physical pain or experienced mental anguish and can satisfactorily prove it.
A: Be sure to read and thoroughly understand Chapter 74 of the Texas Civil Practices and Remedies Code.
A: It can be complex because such cases generally involve opinions of medical professionals who have reviewed the file. You could try to arrange a free initial consult with attorneys. Good luck
