Jacksonville, FL asked in Immigration Law and Criminal Law for Georgia

Q: Have a immigrate serving life but just got letter for deportation. Will he be deported?

He was found guilty of Malice, assault and felony murder. And charged with life with out parole under the state of Georgia judge. He is currently serving time and has been for over a few years now, but recently went in front of a immigration judge and has been ordered to be removed back to Jamaica and ineligibility for any form of relief. I am a very close family friend of this person. He is not looking to stay in America or come back his sole goal is to be successfully deported back to Jamaica. Should we get another lawyer to help with the deportation or is it just a waiting game. And does the immigration order or removal over ride the state of Georgia. He got this removable as charged conclusion back in April of this year.

A: This seems like a complicated situation that must be described better before anyone can understand and answer.

First, how are you related to to the person with the immigration problem? Second, what, if anything, were they arrested and what exact offense(s) (law) were they arrested for, charged with, and where? Third, have they pled or been found guilty in a criminal court? Fourth, has that person actually had a case against them at the Executive Office of Immigration Review charging them with deportation/removal? Fifth, do they have a final removal order or have the given up the right to a removal hearing?

This person ought to seek help as soon as possible, but will likely need to have financial support from others if detained or in jail!
