Q: DACA spouse which she got before she turned 18. She now 27 and recently got the i-130 approved. Is 601a needed?

A: That depends on whether she entered the U.S. legally. We recommend applying for advance parole, if she qualifies, and through that process she would be able to have a lawful entry and then adjust her status.
