Q: Is my lease legally binding in St Louis MO before I move in?
My girlfriend and I are moving to St Louis Missouri. On 07/10/23 we signed lease for a year with an apartment building starting 08/26/23. On 08/17/23, we called the building to confirm the details of the move, but the building manager informed us that unfortunately due to a mistake, our room will not be vacated and available until 09/09/23. They offered for us to stay in another identical room on a lower floor until our room is ready. We confirmed this agreement over email immediately. Then, on 08/24/23, they sent us a surprise new lease agreement for the lower room, and put our room back on the market for a higher price. We're very interested in having our original room, and want to hold them to their agreement to let us stay in an empty room until our leased room is available. If they refuse, are we breaking the law if we choose to live elsewhere? Thank you!
A: It’s not a matter of breaking any law but rather of breaching the lease, a contract. You may sue for breach of contract to recover actual damages or for injunctive relief.
