Boone, NC asked in Car Accidents

Q: I want to have facts in an accident report corrected. How do I go about doing this?

I was t-boned by a Sheriff's Deputy as he crossed three lanes of unstopped traffic on a busy road without using his siren. The resultant intimidation of myself when I was in the ER and the misstatement of facts in the accident report were disgraceful. The homicide officer (yes, homicide officer) who took my sworn statement in the ER and wrote the accident report completely ignored anything I said in favor of what the deputy said. He also misquoted the Florida Move Over law and then said I broke the law. I just want the record set straight. And I want the officer, who has immunity from prosecution, to take responsibility for what he's done. There were no injuries but my car was totaled which will affect my insurance rates and perhaps even cause me to lose my insurance. I am concerned that the Blue Wall went up to protect the deputy and I find myself on the outside.

A: If you want the investigating agency to correct something on the police report then you need to contact the agency and see what they require of you to request a correction. That said, it sounds like you might have a civil claim and as such, before contacing any law enforcement agency, I would recommend that you contact an accident/injury lawyer to discuss your options regarding a civil claim for damages---most attorneys who practive this type law will provide a free initial consult so call a few them and take them up on the complimentary consultation and then hire the lawyer with whom you are most comfortable. Good luck.
