A: With an attorney you have a better chance of presenting your case properly and of convincing the Immigration Judge that it merits approval provided that you have a meritorious case.

A: 1. While you are not required to have an attorney represent you in immigration court, it is generally advisable to have one due to the complexity of immigration laws and proceedings. You have the right to represent yourself; however, statistics show that individuals who are represented by an attorney often have better outcomes in immigration court.

2. While referencing 8 CFR § 208 can be a crucial part of your asylum application, relying solely on it may not be sufficient. It is generally recommended to supplement your case with other relevant laws, case precedents, and country condition evidence to strengthen your asylum claim. Please consult with an attorney to get tailored advice for your specific situation.
