Detroit, MI asked in Probate for Michigan

Q: I feel there has been a breach of financiary duty with the executing of my late mothers will and my inheritance/ trust.

My sisters are trustees and I am a beneficiary. I bought a house with my money but they refuse to put me on the deed. They cannot supply financial records for my beneficiary Acton r which was supposed to exist but does not and they are missing other important financial documents. Also my brother in law has been handling all the expenses not any of my sisters who are the trustees and executors. They want me to pay rent in my own house and are taking the rent money from my tenant I have in my duplex. I feel cheated and feel they is something illegal going on.

A: This is a forum for general questions and answers, not specific legal advice.

You clearly need legal representation, starting from the point of you say you purchased something with YOUR money but it was not put into YOUR name apparently? I don't know that this is so much a 'breach of fiduciary duty' as it is you may not have what you think you have. |

You need to get local licensed legal advice about your situation and have that attorney represent YOUR interests to insure things move forward as they should. Don't be 'penny wise and pound foolish' about this or claim you can't afford an attorney. As you can see from the way this has gone sideways, you cannot afford to NOT have an attorney!

Get your own local legal representation ASAP. Good luck.
