A: Assuming you did not cause the wreck, you and your passengers have what is known as an uninsured motorist claim. While such a claim exists under Georgia law, that does not necessarily mean there is compensation available under your policy. The key is whether your policy has uninsured motorist coverage. If so, both you and your passengers will have coverage available for your injuries despite the fact the wrongdoer failed to stop.

I should also add that your passengers may qualify for uninsured motorist benefits under your policy AND the passenger's individual policies. Be sure to advise your passengers to check with his/her own insurers to see whether uninsured motorist coverage is available for his/her specific injuries.

A: You could check your policy to see what it offers in terms of coverage, whether for property damage or to injuries to you and your passengers. Take photos to serve as evidence of physical contact. Good luck
