Q: As a non-profit 501(c)(3) online academy for SUD Counselors that leads toward a state certification am I exempt?
I applied for a BPPE Exemption, as my school is a non-profit agency that only leads toward certification. I was told by the BPPE that I was qualified as a school by the state, but I do not qualify for an exemption from BPPE because I provide live - internship and practicum experience to my students as well. Does this aspect violate 94874(h)(2)? The BPPE also states that I violated section 94874(h)(3) too because I am not an approved provider for the Dept. of Rehabilitation when In fact, I am an approved educational provider for the DOR and have been working with DOR students since 2019. May I send you a denial letter to my exemption request from the BPPE? I believe they are wrong, and if they thwart my ability to serve the DOR than 49-students will have to be disenrolled in my program. If I am Approved by a DHCS, State Agency, CADTP, why would I be in "violation" if I continue to offer classes that lead toward a SUD Counselor certification? Can an attorney help me to understand?
