Houston, TX asked in Personal Injury for Texas

Q: how can someone sue you if they fell at a gravesite that is not yours but a relative that died 45+ yrs ago

lady of 85 yrs old was called by an investigator if she knew anything about a person's gravesite and she said she was related to him. also, that she doesn't know anything about the siblings and might all be dead. they might have listed her name because she lives where the relative was buried but doesn't know who bought the headstone or where they bought it from and possibly from the cemetery but cemetery has since been sold. apparently someone fell or was injured by the headstone and is now suing the 85 yr old lady. they contacted her because her name was listed somewhere at the cemetery or they know she is related but nothing more. how can she be liable for anything? she is not the owner of the plot. she is not the owner of the cemetery nor responsible for the upkeep of the cemetery and hasn't visited the gravesite since the death over 45+ years ago. she had nothing to do with anything other than being related and doesnt know if the dead relative had any children?

A: It seems unlikely such a lawsuit would be successful.

A: Such a lawsuit would probably be dismissed. If it does materialize into any kind of formal action, consult with a local attorney. Good luck
