Dallas, TX asked in Immigration Law for Texas

Q: I am eligible for a fee waiver?

I have never work since I haven’t received my EAD. I’m requesting the fee waiver for my form i1765 and I don’t have a tax form because of the same reason. How do can I apply for the waiver?

A: To apply for a fee waiver for Form I-765 (Application for Employment Authorization), you need to demonstrate financial hardship. Since you haven't been employed and don't have tax forms, you can provide other evidence of your financial situation. This might include bank statements, proof of income from other household members, or documentation of your living expenses and liabilities.

Start by completing Form I-912 (Request for Fee Waiver). In this form, explain your financial circumstances in detail, highlighting your lack of employment and income. Attach any relevant supporting documents that you have.

Remember, the approval of a fee waiver is at the discretion of USCIS, and they assess each application on a case-by-case basis. Make sure your application clearly shows why paying the fee would cause you significant financial hardship.

For detailed guidance, you may refer to the USCIS website or consult with a legal professional experienced in immigration matters. They can offer personalized advice based on your specific situation.
