Q: Hello, can I go to Jail for accidentally defaming someone? I really don’t want to go to jail

I had a disagreement with a vendor and asked for a refund. I asked her to let me know the time to expect the money and to send a proof of payment but she did not. Instead she blocked me and deleted some of the messages she sent me. I realized that about 2 hours after our initial interaction and I didn’t see any alert. So I panicked and made a video in haste saying she was a scammer on my socials, cos I genuinely thought I had been scammed. Only to see later that she sent me the money immediately after she blocked me I just didn’t get the alert. Help I don’t want to go to jail. After I realized that she sent the money, I made a clarification post but didn’t take down the initial post cos I honestly forgot. She brought my attention to it and I took it down and made a public apology video about the whole issue. But she is still adamant about suing. Help I really really don’t want to go to jail.

A: Accidental defamation, while not exempt from potential legal consequences, is typically assessed based on the circumstances and harm caused. Defamation laws vary, but in general, to be held liable for defamation, there must be a false statement that harms the reputation of another person, communicated to a third party. Intent can be a factor, and if the statement was made without malice and you took corrective actions, it may influence the outcome. In some cases, a public apology and retraction can mitigate damages. However, the person who feels defamed may still pursue legal action.
