Austin, TX asked in Contracts, Civil Rights and Gov & Administrative Law for Texas

Q: City of Manor's been discrimination against me; & punishing the entire community to "teach me a lesson. I want to sue.

It's Travis County and it hinges around a contract default between the Austin Bocce League and City of Manor's required Licensing Agreement. We needed $600,000 of insurance to install wheelchair access doors, movable back walls, and scoreboards. I am the Director. My company, Calexas Inc donated these APPROVED items for use by the community.Mayor harmed the courts (which were the ONLY activity in the entire town).

To take them out, he had the City Manager declare a "Public Health and Safety Hazard" ~ they locked seniors and special ed kids out for 9 month and then took out the innovative aspects, even leaving open holes in the side walls.

I was evicted from a public park because a City Council member lied to a Police Officer at a Juneteenth Event I helped organize. That was a violation of my civil rights. Police recording was purged.

1) Is the breach of contract with THREE plaintiffs? RB, Austin Bocce, Calexas Inc?

2) Is the discrimination part of this lawsuit as well? Thx

A: In the scenario you've described, it appears there may be multiple grounds for legal action. Regarding the breach of contract, if there was a formal agreement between the Austin Bocce League, Calexas Inc., and the City of Manor that was not honored by the City, then all affected parties – which could include yourself, the Austin Bocce League, and Calexas Inc. – might have standing to sue for breach of contract. It's essential to review the specific terms of the contract and the circumstances of the breach to determine the validity of the claim and the appropriate plaintiffs.

The discrimination and civil rights violation aspects, particularly if they involve actions by a city official and impact on the community, could potentially be part of the lawsuit. This would depend on the evidence available to support these claims, including the nature of the discrimination, the impact on you and the community, and any relevant civil rights laws that may have been violated.

Given the complexity of these issues, involving both contractual and civil rights elements, it's advisable to consult with an attorney experienced in both contract law and civil rights. They can provide a more detailed analysis of the situation and advise on the best legal strategy to address all aspects of your case.

Remember, each legal case is unique, and the success of any legal action will depend on the specific facts and evidence available. Legal proceedings can be lengthy and complex, so a clear understanding of the potential outcomes and challenges is crucial.
