Arlington, VA asked in Immigration Law for Texas

Q: My Form I-130 has been approved, but I did not receive my approval. what do I do now? I have more info below.

I submitted my Form I-130, Petition for Alien Relative and it was approved in February 2021. However I did not receive an approval letter I can just see the approval online. In May 2022 I submitted my form I-824, but have only received a receipt and nothing else. I've inquired, since for the office taking my case, it is outside of the regular time frame and they say my case has been sent to the NVC. When I reach out to the NVC they have not given me an update. What steps do I need to take now?

A: In your situation, it's important to first verify the status of your Form I-824, Application for Action on an Approved Application or Petition, which you submitted to obtain a copy of the approval notice. Since you have already received a receipt for this form but no further updates, you should regularly check the case status online using the receipt number.

Given that your case has reportedly been sent to the National Visa Center (NVC), it is advisable to continue following up with them. The NVC can experience delays, and consistent follow-up may be necessary to get an update on your case. Make sure to provide them with your case number and any relevant details to assist in their search.

If you find that you are not making progress with the NVC, consider reaching out to a legal advisor for assistance. They can help in communicating with the NVC and ensuring that your case is being handled appropriately. In some cases, they may also recommend additional steps or actions to expedite the process. Remember, patience and persistence are key in navigating immigration processes.
