Q: What are the requirements to meet Common Law Marriage in the state of Texas?

A: 1. There must be an agreement between the parties to be married;

2. After the agreement, the parties must live together in Texas as spouses; and

3. The parties must represent to others in Texas that they are married.

Alternatively, the parties may file a written declaration of informal marriage on the prescribed form with the county clerk.

A party may not be "common law" married to a person if they are presently married to someone else. A party may not be "common law" married if they are under 18 years of age.
