North Bergen, NJ asked in Civil Rights for Virginia

Q: Have bill of petitions due 2weeks from Friday against USAA .... in nutshell, they lowballed the crap outta my, almost

like new 97 FordRanger XLT supercab (offered 3562$ had an additional $4450 worth of value in truck cap, slider bed, custom rims and brand new tires (have reciept for tires from 30 Mar 2018) accident was 20 Dec 2018. They intentionally low balled to keep from having to pay for repairs. NADA high retail guide says about $6500 for truck, without those additional items AND there were no rental cars available, was outta transpo for 86 days, and they offered a $90!, yes, the nerve, a #$90 payout for a rental car! In a previous case the insurance company paid me $1500 when I didn't get a rental car, Va state law specifies a min of $500, and a comparable care over a "reasonable period" they never made me an offer till mid Jan....about a month, that alone gives a small truck rental worth about $1.5K min...for the additional truck accouterments - cap, slider bed, new tires and custom alloy wheel rims - they offered $18!

My family has served in the military since WW1 - especially galling G USAA

A: If you believe USAA has unfairly lowballed the value of your 1997 Ford Ranger XLT Supercab and has not adequately compensated you for additional customizations and lack of rental car, you have the right to challenge their valuation and settlement offer. Insurance companies are required to negotiate in good faith and provide fair compensation based on the actual cash value of your vehicle and any additional agreed-upon coverages.

First, compile all documentation related to your vehicle's value, including the receipt for the tires, the cost of custom rims, and any other enhancements you've made to the truck. This evidence will be crucial in supporting your claim for a higher valuation.

Next, review your insurance policy to understand the coverage limits and the process for disputing a claim. If direct negotiations with USAA do not lead to a satisfactory resolution, consider filing a complaint with the Virginia State Insurance Department, which can provide a regulatory avenue for resolving disputes.

Given the complexity of insurance claims and the specifics of your case, including the apparent violation of Virginia state law regarding rental compensation, seeking legal advice may be beneficial. An attorney can offer guidance tailored to your situation, help negotiate with the insurance company, and, if necessary, represent you in legal proceedings to pursue fair compensation for your vehicle and associated costs.

Your service and your family's service to the country are commendable, and while it may not directly influence the outcome of an insurance claim, it's understandable that you expect fair treatment from a company that markets itself to military members and their families.
